Terms & Conditions

Please have all guests read the contract and rental rules before making payment. As soon as I receive your final payment, I will email you the property address & instructions to get the keys for the home.

CHECK-IN TIME is after 4pm and CHECK-OUT is before 11am, unless noted in reservation booking or notified in writing. An early check-in or late check-out without permission is subject to ADDITIONAL rental fees.

PETS – PETS are permitted in rental only with prior approval. Pet owners are responsible for cleaning up all pet refuse. Pets are NOT allowed on furniture at any time, and any evidence of pets on furniture will incur a $250 fee. All pets must be up to date on all vaccinations including rabies, and are to be treated with Advantage or a topical flea and tick repellent 3 days prior to arrival. The home owners assume no responsibility for illness or injury that humans or pets may incur while on the premises.

DAMAGE/RESERVATION DEPOSIT – For all non-holidays/special events, $250 is due at booking.  The remaining charges including security deposit are due 60 days prior to check in. For all holiday/special event bookings, the entire amount is due at booking.  The security deposit is fully refundable within 14 days of departure, provided the following provisions are met as well as all other rules within this contract.
· No damage is done to unit or its contents, beyond normal wear and tear.
· No charges are incurred due to contraband, non-permitted pets, or collection of rents or services rendered during the stay.
· NO house parties or violation of noise ordinance (quiet time 10pm – 8am)
· All debris, rubbish and discards are placed in trash can and only recyclable items are placed in the blue recycling bin (trash collection day is Thursday), and soiled dishes are placed in the dishwasher and cleaned.
· Home is left secured with ALL doors and windows locked.
· No linens, towels, or other items in the home are lost or damaged.
· Hot tub, if present, is left in working condition.
· No additional guests beyond those listed in this contract have stayed in the home.
· The renter is not evicted by the owner (or representative of the owner) or the local law enforcement, and has had no neighborhood complaints against them.

PAYMENT – For all non holidays/special events, the BALANCE OF RENT is due 45 days before your arrival date, or at booking if guest check-in is less than 45 days away.  For all holiday and/or special events bookings, the entire balance of rent is due upon booking.

CANCELLATIONS – A $250 cancellation fee will be charged for canceled reservations. Cancellations that are made more than 45 days prior to the arrival date will receive any advance payment back minus the $250 cancellation fee. Cancellations or changes that result in a shortened stay, that are made within 45 days of the arrival date, forfeit the full advance rental payment and deposits. For all holidays and/or special event bookings, there are NO REFUNDS except for the deposit.

MAXIMUM OCCUPANCY – Occupancy limits must be followed. If more guests are in the home than agreed upon in this contract, guests to pay additional $100 per person per night. ONLY GUESTS NAMED IN THE CONTRACT ARE ALOWED ON THE PROPERTY. In order to comply with the City of Austin code, no more than 6 unrelated people may stay in any residence.

NO SMOKING – A $350 penalty fee will be charged to your credit card if we find evidence of smoking inside the property.

NO DAILY HOUSEKEEPING SERVICE – While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. Laundry soap, bath soap, toilet tissue, paper towels, and trash bags are NOT always replenished, however if consumables exist at the premises when the guest arrives the guest is free to use them.

FURNISHINGS – Furnishings are subject to change without notice. Furniture and all other items supplied with the rental property must not be taken out of the home. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the guest(s). Guest may not move furniture.

HOT TUB (if applicable) – Guest is hereby notified that the hot tub can be dangerous and guest fully accepts the risks involved. Guest is further notified to be cautious when entering and exiting the areas surrounding the hot tub as wet floors can be a hazard. Do NOT enter home without drying off fully. Guest must keep hot tub covered at all times when not in use. NO glass containers or any kind may be used in or near the hot tub. NO guest under the age of 18 is allowed in the hot tub without adult supervision. Read all signage near hot tub before use.  Not all homes have hot tubs, in addition hot tubs are drained and unavailable from May – September due to the summer heat. Guests agree to use the hot tub at their own risk.

SECURITY – There may be security cameras located on the exterior of the home.  Cameras are clearly visible.

INDEMNIFICATION and HOLD HARMLESS – Guest(s) agree to indemnify and hold harmless the owner for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by guest(s).

INTERNET – Illegal use of the internet is prohibited, including the exchange of unauthorized copies of copyrighted material. Do not give out the internet access information to anyone outside of your party, and do not reset, erase, or modify the router and its settings in any way.

RENTAL ASSIGNMENT CHANGE AND OTHER NON-AVAILABILITY OF PROPERTY– Owner and/or Owner’s Agent reserves the right to cancel this Rental Agreement without prior notice or liability in the event of death, fire, acts of nature, lawsuit, sale of the rental property, or otherwise. Owner shall NOT be liable for events beyond their control which may interfere with guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, or inclement weather. NO REFUNDS or COMPENSATION will be offered in these circumstances.

PARKING – Parking is limited to 2 vehicles for 2 bedroom homes and 3 vehicles for 3 & 4 bedroom homes Vehicles are to be parked in driveway and directly in front of the home ONLY.

OWNER’S CLOSET – Guests agree not to access the “owner’s closet”, even if unlocked, which contains cleaning supplies and chemicals that could be hazardous to children and adults. The owner’s closets are located in the upstairs hall closet and the upstairs front bedroom. Guest agrees not to enter door in each upstairs bedrooms
leading to attic area. Guest may not enter garage.

TOILETS – DO NOT FLUSH anything other than toilet paper, including wipes labeled “flushable.”  NO feminine products should be flushed at anytime and sewer clogs caused by guests will be subject to a $200 fee.

NO candles, fireworks, or hazardous materials are allowed at any time on property.

OUTAGES AND FAILURE OF ITEMS IN HOME – Homeowner CANNOT guarantee against outages or mechanical failure of heating, air conditioning, TVs, DVDs, or other appliances. Please report any inoperative equipment to our office immediately. Owner will NOT reimburse guest for any repairs guest makes or has made to property. Owner will make every reasonable effort to have repairs done quickly and efficiently. NO REFUNDS, RENT REDUCTION, OR COMPENSATION will be made due to outages, failure of appliances, or failure of equipment, nor for outages, content, lack of content, personal preferences, speed, access problems, or lack of knowledge of use with regard
to cable TV service and/or internet service. Cable TV and high speed internet is provided as a convenience only and is not integral to the agreement.

FIRE EXTINGISHER/SMOKE ALARMS – The property has a fire extinguisher under the sink in the kitchen area and outside near the grill. The property has smoke alarms installed and they are believed to function properly at the time of rental. Guest will notify homeowner without delay if a fire alarm “chirps” or has a low battery condition.

AGE REQUIREMENTS – The Renter must be 25 years of age to book this vacation rental or will lose all funds paid to owner and will not be permitted to check in. Guests under the age of 21 unaccompanied by a parent or legal guardian will not be permitted to stay in home and will lose all funds paid to owner.

FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of deposit and/or rental money, and will not be permitted to check in.

NO HOUSE PARTIES – Guests are not permitted to have house parties on the property at any time during their stay. Austin ordinance limits noise after 10:00pm. Any parties or complaints by neighbors or local law enforcement can be grounds for immediate eviction and loss of security deposit, with no refund of rental fees.

SECURITY CAMERAS – Exterior motion activated security cameras may be in use at the home. Cameras are clearly visible.

NOTE – The owner(s) are NOT responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are NOT responsible for the loss of personal belongings or valuables of the guest(s). By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

Please have all guests over the age of 18 read the contract. Upon payment and acceptance of rental agreement, owner will send a confirmation email to guest.

By accepting the reservation and making payment, all guests express full acceptance of all of the above policies, terms, and conditions.
